CIRCULAR NO. 2026-0003 STANDARD ADDITIONAL SANCTIONS FOR DELINQUENT MEMBERS

Pursuant to Interim Board Resolution No. 2026-13, entitled:

“A Resolution Approving, Adopting, and Codifying the Standard Policy on Additional Sanctions to be Imposed upon Delinquent Members of Camella Verra Homeowners Association, Inc.”, the Board of Directors hereby issues this Circular establishing the standard additional sanctions for delinquent members.

 

This Circular shall form part of the administrative enforcement guidelines of the Association and shall apply to all members declared Delinquent Members by the Board of Directors.

 

 

SECTION 1. Definition of Delinquent Member

 

For purposes of this Circular, a Delinquent Member refers to a homeowner or member who has been:

1. Formally declared delinquent by the Board of Directors, and

2. Issued a Certificate of Delinquency by the Association, evidencing such declaration.

 

Only members who have been formally declared delinquent and issued a Certificate of Delinquency shall be subject to the enforcement mechanisms provided under this Circular.

 

SECTION 2. Legal and Contractual Basis

 

This Circular is issued pursuant to the following authorities:

1. Section 8, Article III of the Association By-Laws, which authorizes the Board of Directors to impose additional sanctions on delinquent members;

2. Board Resolution No. 2026-13, which codifies the sanctions applicable to delinquent members;

3. Section 5.12 of the Deed of Restrictions (Parking) signed by homeowners, which provides that homeowners irrevocably authorize the Developer and/or the Homeowners Association and its designated agents to tow illegally parked vehicles at the expense of the homeowner concerned, and that the Association shall not be liable for damages or losses arising from the exercise of such authority.

 

By virtue of the Deed of Restrictions voluntarily signed by the homeowner, compliance with parking rules and enforcement measures constitutes a binding contractual obligation between the homeowner and the Association.

 

Section 3. List of sanctions for Delinquent members

In addition to the sanctions enumerated in Section 3, Article III of the Association By-Laws, the following sanctions are hereby imposed for Delinquent Members:

1. Imposition of Interest on Unpaid Dues – All unpaid maintenance dues, assessments, or lawful charges shall accrue interest in the amount of One Hundred Fifty Pesos (₱150.00) per month, reckoned thirty (30) calendar days from the due date, in accordance with Section 1(c), Article V of the Association By-Laws.

2. Restriction on Clubhouse Privileges – Delinquent members shall be disqualified from availing of free use of the clubhouse and its facilities, including tables and chairs, and shall instead pay the prevailing rental rates applicable to non-members or outsiders.

3. Restriction on Basketball Court Use – Delinquent members shall be prohibited from using the basketball court free of charge and shall only be allowed access subject to the payment of the applicable non-member usage rate, if permitted by the Association.

4. Strict Security Monitoring of Subdivision Entry – Delinquent members shall register in the security logbook upon entry and personally lift the boom barrier. Security guards shall not open the boom barrier for them except in cases of emergency.

5. Restriction on Entry of Truck-Loaded Deliveries – Truck-loaded deliveries intended for delinquent members shall not be permitted entry into the subdivision. The homeowner concerned shall receive such deliveries at the subdivision entrance gate.

6. Street Parking Prohibition and Enforcement Measures – Delinquent members are prohibited from parking vehicles along subdivision streets. Violations shall be subject to clamping or towing after issuance of the required notices. A clamping recovery fee of Five Hundred Pesos (₱500.00) shall apply consistent with Circular No. 2024-005 dated May 21, 2024 and Section 5.12 of the Deed of Restrictions, a separate circular shall be issued relative to this sanction.

7. Disqualification from HOA-Funded Activities – Delinquent members shall be prohibited from participating in activities or events funded by the Homeowners Association.

8. Suspension of Maintenance Services – Maintenance personnel shall not render cleaning or maintenance services in the areas immediately surrounding or directly in front of the property of the delinquent member while the delinquency remains unresolved.

9. Legal Action Against Delinquent Members – In cases where delinquency persists despite written demands and notices, the Association may institute appropriate civil and/or criminal actions, including complaints for fraud or other applicable offenses, and shall be represented by a legal counsel or law firm duly approved by the Board of Directors. Legal expenses and attorney’s fees may be charged to the delinquent member as allowed by law.
